The Bureau of Internal Revenue (BIR) has suspended the requirement for online sellers, content creators and other covered taxpayers to display its Registration Seal Badge online. The pause came days before the compliance deadline and after public criticism. It is a policy reversal worth examining: what the rule was meant to do, why it ran into trouble, and what was promised in its place.

What was suspended

The rule was introduced in April under Revenue Memorandum Circular (RMC) No. 38-2026. It was issued on April 29, 2026, according to tax advisories by PwC and KPMG. It was later supplemented by RMCs 64-2026 and 99-2026.

The badge carries a QR code that lets customers check a seller’s registration. It replaced the need to post the full Certificate of Registration on websites, shopping pages and business social media accounts. It covered online merchants, digital service providers, freelancers, professionals and creators. The BIR had extended the deadline to October 31, and more than 52,700 registrations with the badge had been issued by October 14.

Under RMC No. 113-2026, issued October 26, no penalties will apply during the suspension. Those who already have badges may keep displaying them. The suspension runs until further notice, and the October 31 deadline is also on hold.

Why the rule existed

The badge was designed partly as a privacy measure. A full Certificate of Registration shows a seller’s tax identification number and registered address, which for many small online sellers is their home. A QR badge was meant to let buyers verify a seller without exposing those details.

The broader aim fits a policy trend. The Internet Transactions Act of 2023 sought to build trust in online commerce, and the Ease of Paying Taxes Act of 2024 aimed to simplify compliance. Verifying that online sellers are registered serves both goals.

Why it was paused

Commissioner Charlito Martin cited concerns about data privacy, technical problems and the rule’s scope. The BIR said it will consult the National Privacy Commission and affected taxpayers.

Criticism had grown in the days before. Senators sought a pause on October 24, and actress Rica Peralejo publicly criticised the rule. Sen. Bam Aquino welcomed the suspension.

The reasons given are notable. A rule designed in part to protect privacy was suspended in part over privacy concerns. The BIR has not said publicly what those concerns were: what data the QR code exposes, who can scan it, or how scan data is stored.

The consultation question

The BIR’s statement that it will now consult the National Privacy Commission raises a question it has not answered: was the commission consulted before the rule took effect? Under the Data Privacy Act of 2012, government agencies that process personal data must observe privacy principles. A consultation after more than 52,700 badges were issued is a correction, not a design step.

The scope concern also deserves an answer. Content creators and freelancers do not always sell goods. Whether all of them needed a public-facing badge is a policy choice the BIR has not explained.

What happens to the data

More than 52,700 taxpayers registered for the badge before the pause. The BIR has not said whether the information collected through the badge system will be retained, reviewed or deleted, or whether existing badges will remain valid under any revised rule.

What to watch

Key markers include a published summary of the BIR’s consultation with the National Privacy Commission, a revised circular with a new scope and deadline, and clear guidance for taxpayers who already complied. Until then, the rule is paused, not withdrawn, and no new deadline has been set.
